Welcome to Orchard Solutions. These Terms & Conditions (“Terms”) govern the supply, installation, technical services, consultancy, and product sales offered by Orchard Solutions. By engaging with us (online or offline), you agree to these Terms.

Company Overview

Orchard Solutions provides:

• Orchard development services
• Agriculture consultancy
• Supply of materials and technical installation support
• Online and offline product sales

We are registered in Uttarakhand, India, and serve customers across Uttarakhand, Himachal Pradesh, Uttar Pradesh, and Jammu & Kashmir.

Orchard Development

• Our experts will provide land preparation guidance, visiting once at the start and again when work reaches 50% and 90% completion. Execution is the farmer’s responsibility.
• For pit digging/trench making, experts will guide initially, then revisit after 50% and 100% completion. Execution remains the farmer’s responsibility.
• Our expert will be present on-site for one day at plantation start. Additional days, if required, will incur extra charges.
• Installation charges may vary for small projects depending on accessibility, manpower, and scope.
• Installation of perforated weed mats will be carried out by the farmer.

Field Survey & Suitability

• Field survey charges are INR 10,000 (non-refundable in case of voluntary cancellation).
  • Includes site survey and soil sampling.
  • If the land is found unsuitable, INR 4,000–5,000 will be refunded after the report is issued (depending on distance from HQ/branch).
  • If the project proceeds, the same amount will be adjusted against the final cost.

On-site Support Requirements

• The farmer shall provide suitable room/accommodation for our technical team during execution.
• Orchard Solutions will bear travel, food, and bedding costs for our team.

Warranty & Limitations

• Warranty Coverage:
  • Drip Irrigation Materials: 2 years (UV warranty only)
  • Trellis Structure (service): 1 year
  • Anti-Hail Net & Weed Mat: 5 years (UV warranty only)
• Warranty excludes damage from: theft, natural disasters, wild animals, fire, rodents, or accidental damage from tools/machinery.
• The farmer is responsible for sourcing additional items such as cement, sand, gravel, fertilizers, chemicals, water tanks, pipes, and ladders. Orchard Solutions will not provide these.

Transportation & Logistics

• Transportation from delivery locations to the farmer’s site is chargeable to the farmer.
• Moving materials from unloading point to field is the farmer’s responsibility.
• Loading charges at Orchard Solutions’ delivery point will be borne by us.
• If the site is not ready by the agreed date, installation will be rescheduled after other scheduled projects, and extra charges may apply for waiting time.

Payment Terms

• For Planting Material:
  • 30% booking amount
  • 70% balance before 10th October 2025

• For Other Materials & Services:
  • 30% booking amount
  • 40% at least 15 days prior to dispatch
  • 30% before truck loading

👉 100% advance is mandatory before dispatch of any material or start of services.

Technical Consultancy

• One year of technical consultancy is complimentary, covering:
  • Post-plantation pruning
  • Winter pruning
  • Unlimited on-call support during the first year

Pricing

• Base service charge: ₹5,000
• GST @ 18%: ₹900
• Total payable: ₹5,900

Prices are indicative and may vary by ±5% based on site conditions and scope of work.

Cancellations

• Pricing is indicative and may vary up to ±5%.
• Once a booking is confirmed, cancellations or scope changes must be requested at least 15 days in advance. Cancellation charges may apply.

Supply of Planting Material

• Planting material will be supplied through our official partner — a NHB-registered nursery based in Himachal Pradesh.
• While we ensure high-quality material, 100% survival cannot be guaranteed. A 10–20% mortality rate may occur due to transportation, climate, soil adaptability, or farmer handling. Survival rates in past projects have exceeded 90%.
• The presence of the farmer or their authorized representative is mandatory at the time of dispatch/collection from our delivery locations (Haldwani/Chandigarh).
• Once materials leave our delivery location, Orchard Solutions will not be responsible for breakage, loss, or shortage.

E-Commerce/Online Selling

We will either manufacture it for you or source it from the market at the lowest possible cost.

Pricing

• All prices are quoted on an F.O.R. (Free on Road) basis from our Peerumada, Ramnagar warehouse.

Shipping & Delivery

• Orders below ₹400 incur a fixed shipping charge of ₹70.
• Free shipping is applicable for orders above ₹400.
• Taxes and freight charges, where applicable, will be charged extra.
• Orchard Solutions is not responsible for any breakage or damage that may occur during transportation.

Payment Terms

• Prepaid Payments – UPI, Credit Card, Debit Card, Net Banking, Wallets
• Cash on Delivery (COD) – Available for select pin codes and eligible products.

Limitation of Liability

• Orchard Solutions provides services based on best practices but cannot guarantee results affected by external factors such as weather, soil, or farmer practices.
• We are not liable for indirect or consequential damages, losses, or delays outside our control.

Intellectual Property

All content, designs, and materials on our website and service documentation belong to Orchard Solutions and may not be copied or reused without permission.

Governing Law

These Terms are governed by the laws of India. All disputes will fall under the jurisdiction of the Ramnagar (Nainital) Court.
